1. Agreement

These Terms of Service (“Terms”) govern your access to and use of the GenImagePro website and any related marketing or waitlist experiences we provide (collectively, the “Services”). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

2. What GenImagePro is today

GenImagePro may be in pre-launch or preview form. The site may describe planned or aspirational product capabilities. We do not guarantee that any feature, price, or timeline on the site will ship exactly as written.

3. Waitlist and communications

If you join the waitlist, you agree that we may send you email or other messages about GenImagePro, including launch and product updates. You can unsubscribe from marketing messages using the link in those emails where provided, or by contacting us through the same business channel you used to reach GenImagePro.

4. Acceptable use

You agree not to:

Use the Services in violation of law or third-party rights;
Attempt to probe, scan, or test the vulnerability of our systems without authorization;
Overload, disrupt, or interfere with the Services or other users;
Use automated means to access the Services in a way that imposes an unreasonable load;
Misrepresent your identity or affiliation.

5. Intellectual property

The Services, including branding, text, graphics, and layout, are owned by GenImagePro or our licensors and are protected by intellectual property laws. You may not copy, modify, or distribute our materials except as allowed by law or with our written permission.

When a product is available, separate terms will govern what you may do with inputs and outputs (for example commercial licensing). Until then, do not assume any license beyond ordinary personal browsing of this site.

6. Third-party services

The Services may link to or integrate with third-party sites or tools. We are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk.

7. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GENIMAGEPRO AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICES IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICES GIVING RISE TO THE CLAIM IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) FIFTY US DOLLARS (US $50), IF YOU HAVE NOT PAID US ANYTHING FOR THE CLAIMED ACTIVITY.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

9. Indemnity

You will defend, indemnify, and hold harmless GenImagePro and its affiliates from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your content, or your violation of these Terms or applicable law.

10. Changes to the Services or Terms

We may modify the Services or these Terms at any time. We will post updated Terms on this page and update the “Last updated” date. Continued use after changes constitutes acceptance of the revised Terms. If you do not agree, stop using the Services.

11. Governing law

These Terms are governed by the laws of the United States, without regard to conflict-of-law rules that would require applying another jurisdiction’s laws. Courts in the venue where GenImagePro’s operating entity is organized may have exclusive jurisdiction over disputes, except where prohibited by law.
